TERMS & CONDITIONS (Nicole Gaviria Therapy LLC)
1. Introduction
Welcome to Nicole Gaviria Therapy LLC (“Company,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) outline the agreement between you (“client,” “you,” “your”) and Nicole Gaviria Therapy LLC for services including therapy, coaching, digital products, and online courses.

2. Services Offered
We provide:
- One-on-One Therapy (prepaid or payment plans available)
- Online Group Coaching Programs (live and recorded)
- Digital Products & Online Courses (self-paced learning with lifetime access unless otherwise stated)
- Educational Workshops & Resources
3. Client Responsibilities
For One-on-One Therapy & Coaching Clients:
- Payments must be made in advance via Stripe or bank transfer (NZ clients only).
- 24-hour notice is required for cancellations. Late cancellations or no-shows will be charged at the full session rate.
- Sessions can be rescheduled if notice is given in advance, but frequent rescheduling may result in session forfeiture.
For Online Courses & Group Coaching Clients:
- Participation is at your discretion, but results depend on your level of engagement.
- Group spaces must remain safe and respectful. Any harassment, bullying, or inappropriate behavior will result in immediate removal with no refund.
- You agree to respect confidentiality and not share sensitive group discussions.
4. Confidentiality & Privacy
- We follow HIPAA & New Zealand privacy laws to protect your confidentiality.
- Any information shared during private therapy or group coaching is confidential except when disclosure is required by law (e.g., harm to self or others).
- Your personal and payment information is securely processed via Stripe.
5. Intellectual Property Protection
- All content, including videos, PDFs, worksheets, and resources, is owned by Nicole Gaviria Therapy LLC.
- You may not copy, distribute, or resell any materials.
- Violation of this policy may result in termination of access and legal action.
6. Refund & Cancellation Policy
For One-on-One Therapy & Coaching:
- No refunds for missed sessions unless canceled at least 24 hours in advance.
- Rescheduling is allowed for illness, but repeated cancellations may result in session forfeiture.
For Online Courses & Digital Products:
- No refunds once access has been granted.
- If you experience technical issues, we will assist in resolving them.
- As per NZ consumer law, refunds may only be granted in cases of faulty or misrepresented content.
For Group Coaching Programs:
- No refunds once the program begins.
- Failure to attend live sessions does not qualify for a refund.
- Violating group agreements (e.g., unsafe behavior) may result in termination with no refund.
7. Liability Disclaimer
- Our services do not replace medical treatment.
- You understand that therapy, coaching, and educational resources are voluntary.
- We are not liable for direct or indirect consequences of participation.
8. Termination Policy
We reserve the right to terminate access to:
- Therapy, coaching, or courses for non-payment, violation of terms, or inappropriate behavior.
- Clients removed due to behavioral violations will not receive a refund.

BILLING AGREEMENT
1. Payment Structure
- Payments for therapy sessions, coaching, and digital courses must be made in full upfront or via a payment plan.
- All payment plans must be completed in full, even if you discontinue participation.
- Accepted Payment Methods: Stripe, bank transfer (NZ clients only).
2. Late Payments
- A $15 NZD late fee applies for payments overdue by 7 days.
- If a payment is 14+ days overdue, access to services may be suspended.
- Accounts unpaid for 30+ days may be sent to collections.
3. Chargebacks & Dispute Resolution
- If a chargeback is filed without first contacting us, access to all services will be revoked.
- If you believe a charge is incorrect, please contact us at hello@nicolegaviriatherapy.co.nz within 7 days of the transaction.
- Fraudulent chargebacks will be contested through Stripe.
4. Refund Policy for Digital Products & Courses
- No refunds once a course or digital product has been accessed.
- If required by NZ law, refunds may only be issued if the product is faulty or not as described.
5. Subscription & Payment Plan Agreement
- If you enroll in a payment plan, you agree to complete all installments.
- Missed payments will result in suspended access until payment is caught up.
- Payment plans cannot be canceled after the first payment.
6. Modifications to Terms
We reserve the right to update these Terms & Billing Policies at any time. By continuing to use our services, you agree to the latest version of these Terms.
